Many attorneys are reluctant to discuss spousal control and remarriage protection issues in estate planning meetings with couples. Yet this discussion is essential, even if it is ultimately decided between the spouses that no such controls or protections are necessary. Why? Because it is a healthy discussion in general and part of client education and awareness, and because statistics show that a substantial majority of men remarry after the death of a spouse, while slightly less than a majority of women remarry under the same circumstances. There is nothing to fear, and in most situations this discussion takes on a humorous element.
