SUMMARY:Webinar - Supported Decision Making for Families and Loved Ones Living with Traumatic Brain Injury
DESCRIPTION:Supported Decision Making (SDM) involves persons with disabilities being able to make their own decisions to whatever extent they can\, provided that they have enough support to do so. Now law in Maryland\, Supported Decision Making represents a huge breakthrough for people living with disabilities\, as it does not take away their rights of self-determination; rather\, it allows them to appoint a supported decision maker\, even if they are under guardianship. However\, this dramatic paradigm shift brings with it the element of risk\, potential confusion for parents and others\, and unanswered questions. In this webinar\, Elville and Associates’ Managing Principal and Lead Attorney Stephen Elville will explore the new Supported Decision Making law and its possibilities for loved ones with disabilities. This webinar focuses on the new promise of SDM for persons with disabilities and the current status of this alternative to guardianship and potential guardianship supplement\, and how SDM has the potential to affect and change so many lives\, including those of family members and other supporters.\n\nLearning objectives include:\n~Understanding Supported Decision Making under the new law\, what it is\, what is its purpose\, and what is its current status? What is its promise in Maryland? What are the problems?\n~What Supported Decision Making is not. What is Supported Decision Making’s relationship to powers of attorney\, advance medical directives\, and guardianship?\n~How Supported Decision Making works\, how it can benefit loved ones with disabilities\, and its current status in Maryland.\n\n\n\n\n\nTo RSVP for this webinar\, please click here.  Should you have any questions beforehand\, please contact Jeff Stauffer\, Community Relations Director\, at jeff@elvilleassociates.com\, or 443-393-7696 x117. We look forward to hosting you!

SUMMARY:The Elville Webinar Series: An Overview of Special Needs Trusts and ABLE Accounts - Planning for Unique Circumstances
DESCRIPTION:Presenting will be Elville and Associates’ Principal Attorney Lilly Hummel\, Clover Leaf Wealth Strategies’ Chartered Special Needs Consultant Cortney Heykoop\, and Maryland ABLE’s Outreach Coordinator Kelly Nelson. \nSpecial needs trusts and ABLE accounts are powerful planning tools\, yet they are quite different and each has its own set of rules and requirements. Families with loved ones with disabilities must understand both special needs trusts and ABLE accounts before establishing one or the other. \nIn many instances\, it is beneficial to create both. The counsel of a special needs planning attorney is crucial to this decision-making process. Families with special needs loved ones often face unique financial circumstances that require specialized planning and expertise. A special needs financial advisor can provide guidance and support in navigating these issues\, ensuring the long-term financial security and well-being of the family and special needs loved one. \nTo RSVP and receive your personal link to attend\, please click here. \nThis presentation will feature relevant and critical information provided by three subject matter experts. Ample time will be afforded for your question as well! \nShould you have any questions\, please contact Community Relations Director Jeff Stauffer at jeff@elvilleassociates.com\, or 443-393-7696 x117. SUMMARY:Webinar - How to Achieve Perfection for Your Legacy - Intentionalism in Estate Planning
DESCRIPTION:Many people want to achieve excellence in their estate planning – to establish an estate plan that works as intended – one that will stand the test of time\, accomplish personal goals and priorities\, provide for the disposition of assets in the desired way to the persons and/or organizations of choice\, controlling costs\, and setting forth values\, ideas\, concepts\, and aspirations – organized by leading-edge legal-technical concepts that are up to date at the time of death\, and guided by highly instructional letters of wishes or memorandums.  Yet few people understand the kind of estate planning process necessary for the realization of this ideal\, and even fewer people are offered the opportunity to participate in the kind of process necessary to facilitate the same.  To say that achieving true excellence in estate planning is akin to successfully sailing around the world alone is not an exaggeration.  It takes all of the stuff of legend\, including purpose\, persistence\, patience\, and introspection; partnership with your estate planning attorney and an adequate process forward (facilitated by the attorney); maintenance and updating of the estate plan over time; and more.  In short\, true excellence in estate planning requires being extremely intentional.  In this webinar\, Stephen R. Elville\, Managing Principal and Lead Attorney with Elville and Associates\, P.C.\, will lead a discussion about Intentionalism in estate planning.  Topics of discussion will include: \n\nWhy being intentional in estate planning matters;\nUnderstanding the risks in estate planning;\nWhy knowing what you want out of estate planning matters;\nAvoiding estate plan failure\, and why estate plans may not work as intended;\nMaintaining and updating your planning;\nThe importance of Partnership\n\nPlease click here to register for the presentation and receive the webinar link ahead of time.  Should you have any questions beforehand\, please contact Community Relations Director Jeff Stauffer at jeff@elvilleassociates.com\, or at 443-393-7696\, x117. \nOpen to clients\, advisors\, and the general public.  1.5 continuing education credits will be available for most advisors who attend this presentation.  We look forward to hosting you! \n#elvilleeducation \n#elvillewebinarseries

SUMMARY:Webinar: Planning for a Loved One With Special Needs – An Overview of Guardianship\, Supported Decision Making\, and Special Needs Trusts
DESCRIPTION:  \nElville and Associates has been privileged to educate\, counsel\, and guide families with loved ones with special needs for many\, many years. We continue this through our longstanding partnership with NAMI (National Alliance on Mental Illness) as Elville and Associates’ Managing Principal and Lead Attorney Stephen Elville\, J.D.\, LL.M.\, offers an interactive\, educational discussion about guardianship\, Supported Decision Making\, and special needs (supplemental needs) trusts. \nThe decision to pursue guardianship — to obtain the legal authority to make decisions for another person — is one that has many intricacies to it and should not be taken lightly. There are also many alternatives to guardianship to consider as well\, which is why speaking with a qualified attorney is extremely important during the decision-making process and throughout the guardianship proceeding. \nSupported Decision Making (SDM) involves persons with disabilities being able to make their own decisions to whatever extent they can\, provided that they have enough support to do so. Now law in Maryland\, Supported Decision Making represents a huge breakthrough for persons living with disabilities\, as it does not take away their rights of self-determination; rather\, it allows them to appoint a supported decision maker\, even if they are under guardianship. However\, this dramatic paradigm shift brings with it the element of risk\, potential confusion for parents and others\, and unanswered questions. \nA solid foundation for planning for loved ones with special needs encompasses these two topics along with several others. Understanding what is involved in the planning process for a special needs family and the importance of preserving your loved one’s financial security\, quality of life\, and well-being are further keys to planning success. Estate planning to protect families’ assets along with the types of special needs trusts and their specific purposes (along with who the decision makers and beneficiaries can be in these trusts) are of paramount importance. \nMr. Elville will discuss the following\, and more: \n• What is guardianship?\n• What are guardianship’s benefits and drawbacks?\n• What are the main questions every family should ask before making the decision to pursue guardianship?\n• What are some of the alternatives to guardianship?\n• Understanding Supported Decision Making under the new law – what is its purpose\, and what is its current status? What is its promise in Maryland? What are the problems?\n• What Supported Decision Making is not. What is Supported Decision Making’s relationship to powers of attorney\, advance medical directives\, and guardianship?\n• How Supported Decision Making works and how it can benefit loved ones with disabilities.\n• What are the types of special needs trusts and what trusts best fit different situations?\n• What are some other tools and resources families should consider when planning for loved ones with special needs? \nTo RSVP for the presentation ahead of time and receive your personal link to attend\, please click here. \nShould you have questions ahead of time\, please contact Community Relations Director Jeff Stauffer at 443-393-7696 x117\, or jeff@elvilleassociates.com. People receiving federal and state means tested benefits such as SSI and Medicaid are not permitted to have assets over $2\,000 without jeopardizing their vital benefits. This asset limit has created a cycle of poverty for people with disabilities by forcing it those receiving public benefits to spend down their assets just to maintain their benefits. The Stephen Beck Jr. Achieving A Better Life Experience (ABLE) Act\, passed in 2014 has made it possible for people with disabilities to save for everyday expense and invest for the future without jeopardizing their vital benefits. With an ABLE account\, people with disabilities can build self-reliance as they can save for their goals as well as pay for the additional costs of living with a disability while still maintaining waiver benefits such as food\, energy and housing assistance. According to the National Association of State Treasurers (NAST) there are 150\,615 ABLE accounts nationwide with $1.49 billion in assets. Still there are many people with disabilities who are not benefiting from an ABLE account because they either have not heard of ABLE or do not understand how ABLE programs work.  \nPresented by Maryland ABLE’s Outreach and Communications Manager Kelly Nelson\, attendees of this presentation will learn about the ABLE Act\, the eligibility criteria\, account management process\, how funds can be used to pay for qualified disabilities expenses\, tax-advantaged savings and investment options\, online gifting and a prepaid card for easy access to funds. \nTo RSVP and receive your personal link to attend\, please click here.  Should you have any questions before the webinar\, please contact Community Relations Director Jeff Stauffer at jeff@elvilleassociates.com\, or 443-343-8529 x117.  We look forward to hosting you! \nOpen to clients\, financial advisors\, and the general public\, 1.5 continuing education hours are available for most professionals who attend this presentation. \n#elvilleeducation \n#elvillewebinarseries \n[/et_pb_text][/et_pb_column][/et_pb_row][/et_pb_section]

We continue this through our longstanding partnerships with The Arc of Frederick County and The Arc Northern Chesapeake Region as Elville and Associates’ Managing Principal and Lead Attorney Stephen Elville\, J.D.\, LL.M.\, offers an interactive\, educational discussion about guardianship\, Supported Decision Making\, and special needs (supplemental needs) trusts.\nThe decision to pursue guardianship — to obtain the legal authority to make decisions for another person — is one that has many intricacies to it and should not be taken lightly.
